Important points in the contract with the contractor
Construction contract
It's official; construction is about to begin. Now only to arrange the construction contract! But how do you know what to look for? A contract is often very woolly written and can be tens of pages thick. Nevertheless, this agreement is one of the most important documents during construction. All agreements between you and Zbranek & Holt Custom Homes are recorded in the contract. If discussions ever arise, the contract will look at what has been agreed between both parties.
Verbal agreement
A verbal agreement has often already been concluded before the contact. This is the sign for the consultant to draw up the contracting agreement and accompanying documents. This verbal agreement is already binding when building a new house by law. The content of this verbal agreement is often debatable, which is why the drafting of a contract is necessary. This way, you record all agreements on paper. But, of course, not every detail can be recorded on paper, and then it would be a whole book. That is why we are obliged "to follow the rules of good and proper work."
In the contractor contract
When building a new house, a contract is very important, both for you and us as the builder of the house. It sets out the rights and commitments of both parties. Please note that the following items are included in the contract:
- Details of the contracting parties
- Description of the product to be delivered
- The contract price (including VAT)
- The construction time - is usually indicated on workable days
- The payment arrangement - the so-called payment terms
- Resolutive conditions - to the extent applicable
- A dispute settlement
- General delivery conditions - or a reference to them
Extra security
If you are going to build a house, it is wise to find out which guarantees are attached to the house. These guarantees offer security and are unburdening. They ensure that every Dutch builder can live well. They achieve this through sound financial and technical guarantees. At Zbranek & Holt Custom Homes, you can choose between a contract by the Zbranek & Holt Custom Homes guarantee conditions or a contract under the Zbranek & Holt Custom Homes guarantee. In an earlier blog, we wrote regarding the differences between the two.
In short, it means that the mortgage lender may sometimes be obliged to take out a contract under the Housing Deposit Guarantee. This offers extra security in the event of bankruptcy. However, there are costs associated with this extra warranty. In addition, the Zbranek & Holt Custom Homes contract conditions are already very flexible, and excellent warranty conditions have been included in the Zbranek & Holt Custom Homes contract. And if you do run into problems, we have a complete Service Team ready to help you.
Resolutive conditions
It is wise to contain one or more additional resolutive conditions in the contract. For example, obtaining financing, obtaining a building permit, or selling your current home. Once the contract has been signed, you still have three days to change your mind. If the house is built with a Housing Deposit guarantee, a cooling-off period of one week applies.
Supreme moment
Finally, we have one last Zbranek & Holt Custom Homes Tip: It may be obvious, but read it carefully once the contract has been drawn up! Ensure that all contracts are on paper so that you are not faced with surprises!
Have you read everything, and it is clear throughout the contract? Then nothing stands in the way of drawing and starting with your dream home. So fulfill your agreement to go to the Austin custom home builder. A fun moment to celebrate!
